Terms of Service

These terms apply to IntelixPulse, run by Aptivix Technologies, India. By creating an account or using the service you accept them on behalf of yourself and the company you register.
1. Accounts
The person who signs a company up becomes its administrator and is responsible for the people they add. Keep sign-in details private; you are responsible for what happens under your account. Give accurate details: we verify email addresses and mobile numbers.
2. What you may monitor
Only monitor servers, websites and networks that you own or are authorised to test. Do not use the service to attack, overload or probe systems without permission, to send unwanted messages, or to break any law. We may suspend accounts that do.
3. Plans and payment
Every company starts on the Free plan, with the limits shown in the app. Paid plans raise those limits; you ask for one in the app and we confirm the price and payment terms before switching. Prices exclude taxes. If a paid plan is not renewed, the company returns to the Free plan’s limits.
4. Alerts are best effort
Checks run on a schedule from our servers and alerts depend on email, WhatsApp and push services we do not control. A check can miss a short outage and an alert can be delayed. Do not rely on IntelixPulse as your only safeguard for safety-critical systems.
5. Your data
Your monitoring data remains yours. You let us store and process it to provide the service, as described in the Privacy Notice.
Agents you install report data that can relate to your staff: who is signed in to a device, the accounts processes run under, installed software, and the people assets are assigned to. For that personal data your company is the Data Fiduciary under India’s Digital Personal Data Protection Act, 2023, and we act as your Data Processor: we process it only to provide the service, on your instructions (your settings in the app are those instructions), keep it secure, help you answer your staff’s requests, tell you without delay of a breach that affects it, and erase it when you close your account. You are responsible for telling your staff about the monitoring and for having a lawful basis for it. A written data processing agreement is available on request.
6. Availability and changes
We work to keep the service available but do not promise it will be uninterrupted. We may change or improve features; we will tell administrators before removing something they rely on.
7. Ending
You may delete your account at any time from your profile. If the last administrator deletes theirs, the company is closed and its data erased within 30 days. We may suspend or close accounts that break these terms, after notice unless the breach is serious.
8. Liability
To the extent the law allows, the service is provided “as is”, and our total liability for any claim is limited to the fees you paid us in the three months before it. We are not liable for indirect losses such as lost profit or data.
9. Law
These terms are governed by the laws of India, and the courts of Delhi have jurisdiction.
